Congressional Hearing Explores Harmonized National Approach to Packaging Claims

AMERIPEN, a leading policy and advocacy organization representing the entire packaging value chain, today welcomed a hearing on the Packaging and Claims Knowledge (PACK) Act, legislation that would establish a uniform federal framework for recyclable, compostable, and reusable claims on consumer packaging. 

The hearing, held by the House Energy and Commerce Subcommittee on Commerce, Manufacturing, and Trade, represented “an important opportunity for lawmakers to address growing consumer confusion and the increasing complexity created by a patchwork of state packaging-claims requirements,” AMERIPEN says. 

As consumers increasingly seek clarity about which packaging to recycle, compost or reuse, companies are navigating an expanding array of state-specific requirements governing these related claims. The PACK Act would create a national framework administered through the Federal Trade Commission (FTC), “helping ensure consumers receive accurate, transparent information while providing businesses with greater regulatory certainty across state lines,” AMERIPEN says. 

"Today's hearing underscores the urgent need for a harmonized national approach to these packaging claims," said Lynn Dyer, President of AMERIPEN. "Consumers deserve accurate and trustworthy information about recyclable, compostable, and reusable claims on packaging, verified by an independent third party. At the same time, manufacturers, retailers, and brand owners need a consistent framework that allows them to communicate accurately with consumers regardless of where their products are sold. The PACK Act provides a practical, commonsense solution that advances transparency, informs consumer decision-making, and supports efficient interstate commerce." 

Packaging plays a critical role in protecting products, reducing waste, and ensuring the safe distribution of goods throughout the economy. However, AMERIPEN says, varying state requirements for recyclable, compostable and reusable claims have created compliance challenges for businesses operating nationally and have increased the potential for consumer confusion regarding proper end-of-life management of packaging materials. 

AMERIPEN says the PACK Act would address these challenges by:

  • Establishing a national framework for voluntary recyclable, compostable, and reusable claims on consumer packaging. 
  • Maintaining FTC oversight of these claims while incorporating technical expertise and input regarding implementation. 
  • Requiring accredited third-party certification to help ensure claims are accurate and supported by recognized standards. 
  • Reducing conflicting state requirements and promoting consistency for consumers and businesses nationwide.
