The goal of the branding process is to come up with names, slogans, logos or other indicia, that make people immediately think of your products – and no one else’s. One of those other indicia is color. How can you establish enforceable trademark rights in the colors used in your branding? Color can be legally protected as a trademark, and even registered as a trademark in the U.S. Patent and Trademark Office under certain circumstances. How you go about this depends on how you are using color in your branding.
